Please read the following terms and conditions carefully. They describe the nature of the coach-client relationship, privacy and payment information, cancellation policy, and the use of the platform. By accessing or using the platform, and by checking the Acknowledgement box, you ("Client") agree to the following terms with respect to your professional relationship with Ashley Bourbeau ("Coach") and The Higher Human:
1. Coaching Relationship
Coaching is a thought-provoking and creative process designed to inspire clients to maximize their personal and professional potential. The client acknowledges responsibility for taking action to achieve results. The coach will provide honest, direct feedback, challenge the client, and use various techniques to help move forward.
Coaching is not therapy and does not substitute for professional advice or medical treatment.
The client is responsible for seeking independent professional guidance as needed.
2. Changes to Terms
The Higher Human reserves the right to modify or replace these Terms at any time. Notice of any changes will be provided by posting updated terms on the platform, and continued use after such notice constitutes acceptance of the updated Terms.
3. Cancellation Policy
Clients must cancel or reschedule at least forty-eight (48) hours in advance. Cancellations within 48 hours may result in losing credit for the session.
Use of the Platform
4. Eligibility & Account Security
You must be at least 18 years old to use the platform. You are responsible for maintaining the security of your account and notifying The Higher Human immediately if any unauthorized access occurs.
5. Prohibited Activities
You may not use the platform for any illegal or unauthorized purpose, and you agree to comply with all applicable laws.
Record Retention & Privacy
6. Privacy & Record Retention
Client session recordings will only be stored with permission and will be automatically deleted after 30 days. The coach maintains confidentiality and does not share, sell, or exploit any client information.
Payments are processed through third-party systems. The Higher Human is not liable for issues with these third-party services.
Your use of the platform is also governed by our Privacy Policy.
Termination & Refunds
7. Termination of Services
The client may cancel services, adhering to the 48-hour cancellation policy. Refunds will be granted on a limited basis, with a 75% refund only if no more than one session has been completed.
The Higher Human reserves the right to terminate or suspend your access to the platform at any time, without notice.
Liability & Dispute Resolution
8. Limitation of Liability
The Higher Human and Coach shall not be liable for any indirect, incidental, or consequential damages resulting from the use of services or the platform. The coach’s total liability is limited to the amount paid for services rendered.
9. Dispute Resolution
In case of any disputes, the client and coach agree to attempt mediation within 60 days. If unresolved, the prevailing party in legal action shall be entitled to recover attorney’s fees and court costs.
Governing Law & Severability
10. Governing Law
These Terms shall be governed by the laws of the state where The Higher Human is registered.
11. Severability
If any provision of these terms is held invalid, the remaining provisions shall continue in effect.
12. Binding Effect
These Terms are binding upon the parties and their successors and permissible assigns.
